What this is about

EU AI Act and process automation, what applies since 02.02.2025.

Anyone automating processes with AI does not work in a legal vacuum. Since 02.02.2025, Art. 4 of the EU AI Act applies, the AI literacy duty. It requires that people who deploy or operate AI systems have sufficient competence in handling this technology. For process automation with AI this means it is not enough to switch on a tool. Your team must understand what the AI does, where its limits are and how results are checked. We set up automation from the start so this requirement is met.

What comes in: PDF invoices, E-mail requests, Orders, Forms, Excel sheets, Onboarding. AI + RPA. Where it lands: SAP, CRM, DATEV, Approval.

Art. 4 AI literacy duty in plain terms

The AI literacy duty aims to prevent AI from being used blindly as a black box. Those involved should be able to assess how a system arrives at its results, what risks exist and when a human must intervene. This is not bureaucracy for its own sake but good practice. That is why we build automation with clear approvals, traceable steps and documented decision rules. So the process stays auditable, and your team can prove that it understands and controls the AI it uses.

GDPR and data protection

Alongside the AI Act, the GDPR still applies. Process automation often handles personal data, for example in invoices, orders or applications. We work with servers and data in Germany and the EU, clear roles and logged steps. Every automated action is traceable. On request we document the processing so it fits your internal policies and is soundly justified in the interplay of GDPR and AI Act. Data protection is not an add-on here but part of the architecture.

How we implement compliance in practice

  • Compliance is not created by a document at the end but by the way things are built.

  • We define which cases run through automatically and which need a human approval.

  • We log every step so it can be checked in case of doubt.

  • We record which data is processed and where it resides.

  • And we make sure your team builds the necessary AI literacy, whether through a short introduction or accompanying enablement.

  • So the AI Act turns from an obstacle into a trust argument towards customers and auditors.

What you gain

  • You gain automation that is not only fast but also auditable.

  • You gain trust with management, works council and customers, because what the AI does is traceable.

  • And you gain peace of mind, because you are prepared for auditor questions.

  • Compliance and ROI are no contradiction.

  • A cleanly built process is usually also the more robust one.

FAQ

What exactly does Art. 4 of the EU AI Act require?
Since 02.02.2025, Art. 4 requires sufficient AI literacy for everyone who deploys or operates AI systems. People should understand how a system works, where risks lie and when they must intervene. For automation with AI this means clear approvals, traceable steps and a team that can control the AI it uses.
Is process automation with AI a high-risk system?
It depends on the use case. Many automations in accounting, logistics or HR administration are not high-risk in the sense of the regulation. Where decisions of greater consequence are made, we classify the case carefully and set the appropriate controls. We clarify this early instead of being surprised later.
How do you ensure GDPR-aware setup?
Through servers and data in Germany and the EU, clear roles, logged steps and documentable processing. Personal data is only processed where the process requires it. On request we provide the evidence your internal data protection review needs.
Does my team need AI training?
Usually yes, at least a short, practical introduction. The AI literacy duty requires that those involved understand the AI in use. We build this understanding alongside the project so the duty is met and your team operates the automation safely.
Does compliance slow down automation?
No, if it is built in from the start. Compliance as an after-the-fact document slows things down, compliance as a way of building does not. Clear approvals and logs are good practice anyway and make the process more robust, not slower.
Does the AI Act also apply to small companies?
The AI literacy duty from Art. 4 applies regardless of company size to everyone who deploys or operates AI. So the Mittelstand is affected too. The good news is that implementation can be lean when built into the automation.
